Terms of Service & Manager Agreement

1. Acceptance of Terms & Eligibility

By creating an account, drafting a squad, or accessing the match simulation engine on topsportses.xyz, you enter into a legally binding agreement with TopSportsES Digital S.L. (Madrid, Spain). You must be at least 18 years old to access our services. If you do not accept these terms in their entirety, you may not use the platform.

2. Non-Gambling & Free-to-Play Verification

TopSportsES is an informational, statistical, and skill-based sports simulation game operated solely for recreational and educational purposes. You acknowledge and agree that:

• TopSportsES is not an online casino, sports betting provider, bookmaker, or gambling operator under Spanish Law 13/2011 on Gambling Regulation (Ley 13/2011 de regulación del juego).
• No real money or cryptocurrency is ever staked, wagered, or deposited to participate in our leagues or match simulations.
• No monetary cash prizes, dividends, or financial instruments are distributed to league winners. All leaderboards award purely ceremonial virtual distinctions or non-monetary physical trophies.

3. Manager Accounts & One-Account Fair Play Rule

To maintain competitive equity across all Spanish and European leagues:

• Each natural person may register and control exactly one (1) account.
• Creating multiple accounts (multi-accounting), participating in syndicates to manipulate player valuation algorithms, or sharing account credentials is strictly prohibited and results in immediate disqualification.
• You are responsible for safeguarding your login credentials and for all actions taken under your account.

4. Roster Budgeting & Simulation Usage

Managers agree to assemble squads strictly within the universal €100.0M salary cap and adhere to weekly gameweek lockouts. Automated scraping of our Monte Carlo match simulation engine, automated bot scripting, or reverse-engineering of our BPS calculation endpoints is expressly forbidden.

5. Intellectual Property & Fair Use

All proprietary simulation software, code, user interface designs, custom graphics, and algorithmic weighting systems are the exclusive intellectual property of TopSportsES Digital S.L. Club names and player statistical records are utilized under fair-use provisions for statistical reference, news reporting, and fantasy sports gameplay.

6. Disclaimer of Warranties & Limitation of Liability

TopSportsES provides its simulation engine, data feeds, and scoring services on an "as is" and "as available" basis. While we strive for 99.9% uptime, we do not warrant that statistical feeds will be error-free or uninterrupted during unforeseen third-party telecom outages. In no event shall TopSportsES be liable for any indirect, consequential, or punitive damages.

7. Governing Law & Madrid Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Spain. Any dispute, controversy, or claim arising out of or relating to this agreement shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of the city of Madrid, Spain, without prejudice to any applicable consumer protection rights under European law.
